Real Estate, Land Use and Business Transactions

Mr. McKinney is a transactional attorney at Quattlebaum, Grooms, Tull & Burrow PLLC. Mr. McKinney's practice focuses primarily on real estate and land use, but also includes business transactions, securities transactions and the representation of financial institutions.

Mr. McKinney devotes the majority of his multi-state practice to commercial shopping center development, principally through the representation of major national retailers. Mr. McKinney is involved in nearly every aspect of a complex real estate transaction beginning with the negotiation of a purchase agreement and continuing through the post-closing phase. During the due diligence phase, Mr. McKinney addresses title issues while working closely with engineers, surveyors, architects, environmental scientists and other consultants to secure the proper permits, zoning and other governmental approvals necessary for development. As part of his practice, Mr. McKinney routinely appears before city councils and planning commissions as well as a variety of federal and state administrative agencies. During a typical project, Mr. McKinney also drafts and negotiates a variety of restrictive covenants, easements, development agreements and operating agreements, all custom-tailored to meet the unique needs of each transaction. Mr. McKinney also works on a variety of other real estate projects including the development of apartments, office buildings, warehouses, industrial facilities, condominiums and single-family residential subdivisions.

In addition to real estate projects, Mr. McKinney also advises clients on a variety of business transactions ranging from entity selection and formation to dissolution. He has substantial experience in negotiating and drafting asset and stock sales agreements and agreements ancillary to mergers and acquisitions such as employment and management agreements, covenants against competition and stock option agreements. The balance of Mr. McKinney's practice includes the representation of financial institutions in areas other than real estate including lending, work-out negotiations and reorganizations, usury compliance, check collection issues and customer account relations. Mr. McKinney has also authored articles for the Arkansas Community Banker on federal and state law compliance and presented continuing education seminars for bankers.

A seventh-generation Arkansan, Mr. McKinney was raised in Hot Springs and Little Rock. He graduated from Little Rock Catholic High School for Boys in 1996, and then attended Baylor University as a National Merit Scholar. Mr. McKinney graduated with a double major in Asian Studies and History in 1999. After college, Mr. McKinney attended the University of Arkansas where he earned the degrees of Master of Public Administration and Juris Doctor, cum laude. During law school, Mr. McKinney taught numerous classes for the University of Arkansas Political Science Department, including Introduction to Legal Studies, a course that Mr. McKinney developed for the department.

After graduating from law school in 2002, Mr. McKinney attended Southern Methodist University where he earned a Master of Laws degree emphasizing real estate, land use and business financing and completed his thesis, "Cooperative Development: How Municipalities and Developers Can Achieve Mutually Beneficial Outcomes through Land Use Tools". In 2003, Mr. McKinney published "Factoring the Ambiguity: A Futile Attempt to Understand the Ambiguous Nature of the Integration Doctrine's Five Factor Test" in the Securities Regulation Law Journal.

Mr. McKinney was first licensed to practice law in 2002 after receiving the highest score on the Arkansas Bar Examination in the summer of 2002. Mr. McKinney is also licensed to practice law in the State of Mississippi (2004) and the State of Texas (2003). In 2006, Mr. McKinney was elected Chairman of the Real Estate Section of the Arkansas Bar Association.

Mr. McKinney is a regular public speaker on real estate and economic development issues. Mr. McKinney also serves as Vice-Chairman of the Board of Directors for Arkansas Rice Depot, a non-profit organization that provides food to needy families throughout Arkansas.
